These Terms and Conditions ("Terms") constitute a binding legal agreement between you ("User," "you," or "your") and Benjamin Adams d/b/a Dial Tone Scripts ("Dial Tone Scripts," "Company," "we," "us," or "our"), governing your access to and use of the Dial Tone Scripts platform, including the website located at myscriptorai.com, all associated dashboards, and any software, features, or services made available through them (collectively, the "Service").
BY CLICKING "I AM 18 OR OLDER, AND I HAVE READ AND AGREE TO THE TERMS AND CONDITIONS," CREATING AN ACCOUNT, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS, AND YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OLD. IF YOU DO NOT AGREE, OR IF YOU ARE UNDER 18, DO NOT CREATE AN ACCOUNT OR USE THE SERVICE.
1.1"Account" means the credentialed user profile created upon registration, associated with a single natural person.
1.2"Content" or "Generated Content" means any script, message, recommendation, summary, or other output produced by the Service, including AI-generated sales and customer-service scripts, Debriefs, and Daily Challenge material.
1.3"Customer Data" means any information about your prospects, clients, or customers that you input into the Service, including names, contact details, notes, and profile history.
1.4"Subscription Tier" means the Silver, Gold, or Platinum plan (or any successor plan) you select, each with the features, usage limits, and pricing described at myscriptorai.com/pricing as may be updated from time to time.
1.5"Free Trial" means the introductory period described in Section 3 during which the Service is made available at no charge and without a payment method.
1.6"Dial Tone Scale" and "Guardrail Toggle" mean the configurable generation controls within the Service that adjust the tone and assertiveness of Generated Content, and its compliance posture, respectively.
2.1You represent and warrant that you are at least 18 years old and capable of forming a binding contract. The Service is built for people working in sales and customer service roles, is intended for adults, and is not directed to children. We do not knowingly permit anyone under 18 to create an Account, and we do not knowingly collect personal information from anyone under 18. If we learn that an Account belongs to someone under 18, we will close it and delete the associated data. If you are registering on behalf of a company, you represent that you have authority to bind that company to these Terms.
2.2You agree to provide accurate, current, and complete information during registration and to keep that information up to date. You are responsible for all activity that occurs under your Account and for maintaining the confidentiality of your login credentials.
2.3You must notify us promptly at ben@myscriptorai.com of any unauthorized use of your Account or any other breach of security.
2.4Dial Tone Scripts reserves the right to refuse registration, suspend, or terminate any Account at its discretion, including for violation of these Terms, suspected fraud, or non-payment.
3.1New Accounts receive a Free Trial of seven (7) days. No payment method is required to begin the Free Trial, no charge is made during it, and there is nothing to cancel if you choose not to continue. At the end of the Free Trial, access to script generation ends unless you select a Subscription Tier.
3.2Dial Tone Scripts may, at its sole discretion, grant complimentary or extended access to particular Accounts without charge. Complimentary access confers no ongoing entitlement and may be modified or withdrawn at any time.
3.3The Service is otherwise offered under three paid Subscription Tiers, Silver, Gold, and Platinum, each billed monthly or, at a discounted annual rate, yearly, at the prices displayed at checkout and on the pricing page at the time of purchase.
3.4Usage limits are applied per Subscription Tier and are enforced on a rolling five-hour window together with a daily maximum, as described on the pricing page. Platinum is offered without a per-window limit, subject to a fair-use daily maximum.
3.5Fees are billed in advance on a recurring basis and are non-refundable except as required by law or as expressly stated in a separate refund policy. Subscriptions renew automatically at the then-current rate unless cancelled prior to the renewal date.
3.6You authorize Dial Tone Scripts and its payment processor to charge your designated payment method for all fees incurred. You are responsible for keeping payment information current; failure to do so may result in suspension of Service.
3.7Dial Tone Scripts may change Subscription Tier pricing, features, or usage limits with notice posted to the Service or sent to your account email prior to your next renewal date. Continued use after a price change takes effect constitutes acceptance.
3.8Upgrading or downgrading your Subscription Tier is done from the plans page at myscriptorai.com/pricing, which is linked from your account settings. The billing portal, also linked from your account settings, is where you update your payment method, review past invoices, and cancel. A tier change takes effect according to the terms shown at checkout, and usage limits tied to a lower tier apply from the point the change takes effect.
3.9You may cancel at any time, from the billing portal linked in your account settings. No call, email, or request to us is required. Cancellation takes effect at the end of the period already paid for, and you retain access to your Subscription Tier until that period ends.
4.1The Service uses artificial intelligence to generate scripts, recommendations, and related Content based on your inputs, the selected mode, and your Dial Tone Scale and Guardrail Toggle settings. Generated Content is produced algorithmically and may be inaccurate, incomplete, generic, or unsuitable for a particular customer, transaction, or regulatory context.
4.2Generated Content does not constitute legal, financial, compliance, or professional advice. You are solely responsible for reviewing, editing, and approving any Generated Content before using it in an actual sales, customer-service, or other communication, and for ensuring that communications you send comply with applicable law, including but not limited to telemarketing, consumer protection, data privacy, and industry-specific regulations.
4.3The Guardrail Toggle is a configurable assistive control, not a compliance guarantee. Enabling it does not ensure that Generated Content satisfies any specific legal, regulatory, or company policy requirement. You remain responsible for your own compliance obligations regardless of your Dial Tone Scale or Guardrail settings.
4.4Dial Tone Scripts disclaims all liability for outcomes, representations, or claims made by you or your representatives using Generated Content, including in live customer interactions.

Dial Tone Scripts may suspend or terminate your Account immediately for violation of this Section 5, without refund.
6.1Dial Tone Scripts retains all right, title, and interest in and to the Service, including its software, architecture, templates, trademarks, and all associated intellectual property. These Terms grant you a limited, non-exclusive, non-transferable license to access and use the Service for your own internal business purposes during an active subscription or Free Trial.
6.2As between you and Dial Tone Scripts, you own the Generated Content produced from your specific inputs, subject to Dial Tone Scripts's underlying rights in the Service itself and to the disclaimers in Section 4. Dial Tone Scripts may use de-identified, aggregated data derived from Service usage, including outcome and performance data, to improve the Service, without disclosing your identity or your Customer Data to other users.
6.3You may not use Dial Tone Scripts's name, logo, or branding without prior written consent.
7.1Dial Tone Scripts's collection and use of personal information you provide is governed by our Privacy Policy at myscriptorai.com/privacy, incorporated into these Terms by reference.
7.2You are solely responsible for ensuring you have the legal right and any required consent to upload, store, and process Customer Data about your own prospects and customers within the Service, and for complying with applicable data-protection law with respect to that data.
7.3Dial Tone Scripts will implement reasonable administrative, technical, and physical safeguards to protect Account and Customer Data but cannot guarantee absolute security. You are responsible for maintaining your own backups of critical information.
7.4Generated Content is produced using third-party artificial intelligence infrastructure. Inputs you provide are transmitted to that provider for the purpose of producing Generated Content.
THE SERVICE AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. MYSCRIPTORAI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT GENERATED CONTENT WILL ACHIEVE ANY PARTICULAR SALES, RETENTION, OR BUSINESS OUTCOME.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSCRIPTORAI AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON GENERATED CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MYSCRIPTORAI'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE TOTAL FEES YOU PAID TO MYSCRIPTORAI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Dial Tone Scripts and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of: (a) your use of the Service or Generated Content; (b) Customer Data you upload; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party right.
11.1These Terms remain in effect while you maintain an Account. Either party may terminate a subscription in accordance with Section 3.
11.2Dial Tone Scripts may suspend or terminate your Account, with or without notice, for violation of these Terms, non-payment, suspected fraud, or extended inactivity.
11.3Upon termination, your right to access the Service ends immediately. Dial Tone Scripts will retain or delete your Account data in accordance with its Privacy Policy and applicable data-retention obligations. Sections 4, 6, 8, 9, 10, and 13 survive termination.
Dial Tone Scripts may modify these Terms from time to time. Material changes will be notified via the Service or by email at least fourteen (14) days before taking effect, and you will be asked to accept the revised Terms before continuing to use the Service. Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms. Dial Tone Scripts may also modify, add to, or discontinue features of the Service, including Subscription Tier features, at its discretion.
13.1These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles.
13.2Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Denver, Colorado, rather than in court, except that either party may seek injunctive relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
13.3 YOU AND MYSCRIPTORAI EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. DISPUTES MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY.
14.1Entire Agreement. These Terms, together with the Privacy Policy and any order form or plan description referenced at checkout, constitute the entire agreement between you and Dial Tone Scripts regarding the Service.
14.2Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
14.3No Waiver. Failure to enforce any provision is not a waiver of that provision.
14.4Assignment. You may not assign these Terms without Dial Tone Scripts's written consent; Dial Tone Scripts may assign these Terms in connection with a merger, acquisition, or sale of assets.
14.5Notices. Notices to Dial Tone Scripts should be sent to ben@myscriptorai.com. Notices to you will be sent to the email associated with your Account.
By clicking "I am 18 or older, and I have read and agree to the Terms and Conditions" and completing account registration electronically, you confirm that you are at least 18 years old, and you acknowledge that you have read and understood these Terms and Conditions in their entirety and agree to be legally bound by them, including the arbitration and class-action waiver in Section 13.
